Terms and Conditions

These Terms and Conditions govern the provision of property management services by RENT IN PROPERTY MANAGEMENT to landlords, tenants, applicants, and other users of our services. These terms are written in accordance with the Residential Tenancies Act 1986, Privacy Act 2020, and applicable New Zealand regulations. By engaging our services or interacting with us, you agree to these Terms and Conditions.
1. Scope of Services
We provide residential property management services including, but not limited to:
- Marketing and advertising of rental properties
- Tenant selection and tenancy setup
- Rent collection and arrears management
- Routine inspections and reporting
- Maintenance coordination
- Compliance with tenancy legislation
- Representation in mediation and Tenancy Tribunal proceedings (where authorised)
Services are provided strictly in accordance with New Zealand law.
2. Compliance With Tenancy Law
All services are delivered in compliance with the Residential Tenancies Act 1986, related amendments, and Tenancy Tribunal guidance. Nothing in these Terms overrides statutory rights or obligations of landlords or tenants.
3. Landlord Responsibilities
Landlords agree to:
- Provide accurate and complete property information
- Ensure the property meets all legal standards (Healthy Homes, smoke alarms, insulation, etc.)
- Maintain appropriate insurance cover
- Authorise repairs and expenditure as agreed
- Comply with all legal obligations under tenancy law
Failure to meet these obligations may limit our ability to act.
4. Tenant Responsibilities
Tenants and applicants agree to:
- Provide accurate information during applications
- Pay rent and charges on time
- Maintain the property in a reasonable condition
- Allow lawful access for inspections and repairs
- Comply with the Residential Tenancies Act 1986
5. Tenant Selection and Applications
We assess applications based on lawful criteria only. We reserve the right to decline applications where information is false, incomplete, or where tenancy risk is identified, in line with the Privacy Act 2020 and anti-discrimination laws.
6. Rent Collection and Payments
- Rent must be paid as agreed in the tenancy agreement
- Late or missed rent may result in enforcement action
- All payments are processed in accordance with trust accounting requirements
We are not responsible for tenant default beyond lawful recovery actions.
7. Maintenance and Repairs
- Repairs are arranged as required by law
- Urgent repairs may be authorised without prior landlord approval where legally permitted
- Costs are the responsibility of the landlord unless tenant damage is proven
8. Inspections and Access
Property access will only occur in compliance with notice requirements under the Residential Tenancies Act 1986. Inspection photos and reports are used strictly for management, compliance, and dispute resolution.
9. Tribunal, Mediation, and Disputes
We may act on behalf of landlords in mediation or Tenancy Tribunal proceedings where authorised. Decisions of the Tenancy Tribunal are binding. We are not liable for outcomes beyond our control.
10. Fees and Charges
- Fees are charged as agreed in the management agreement
- Additional services may incur extra charges
- Fees are non-refundable once services are delivered
11. Limitation of Liability
To the extent permitted by law:
- We are not liable for loss caused by tenant actions or omissions
- We are not insurers of property or rent
- Liability is limited to direct loss arising from proven negligence
12. Privacy and Confidentiality
Personal information is handled in accordance with our Privacy Policy and the Privacy Act 2020. Information may be disclosed where required by law or Tribunal proceedings.
13. Restrictions and Justifiable Limitations
We reserve the right to:
- Refuse service where legal, safety, or compliance risks exist
- Suspend services for non-payment of fees
- Decline unlawful requests from landlords or tenants
- Terminate management where legislation is breached
These restrictions exist to ensure legal compliance and fair treatment of all parties.
14. Termination of Services
Management agreements may be terminated in accordance with agreed notice periods and applicable law. Existing obligations survive termination where legally required.
15. Changes to Terms
These Terms may be updated from time to time to reflect legislative changes. The latest version will apply upon publication.
16. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes will be resolved through mediation or the Tenancy Tribunal where applicable.
